'GST food items, grains etc pre-packaged &  pre-labelled retail pack Legal Metrology Act [curd lassi]'

'Now, Pre-packed and pre- labelled food items like wheat, flour, meat, fish, curd, paneer and honey will attract GST,  even if not branded.  Tax will be levied if the goods are pre-packed as per Packaged Commodity Rules, 2011, framed under the Legal Metrology Act, 2009.  It is done to end the disputes such as whether manufacturer\'s name is a brand or not. Or whether the generic names of the product such as मोटा बेसन, बारीक बेसन,  सुपर फ़ाइन सूजी,  are also brands for the purpose of GST or not  47th GST Council Meeting decided to do away with branded or unbranded categorization of these food items for the purposed of GST exemption and instead opt for pre-packaged or unpacked commodities in terms of Legal Metrology Act.  As per Packaged Commodity Rules, all the pre-packaged commodities in \'unit containers\' having goods upto 25kg or 25 litres are required to be affixed with a label containing the prescribed details like, MRP of the packet, generic name of the content, date of packing, manufacturers name, This after the GST Council - the highest decision-making body on the levy of goods and services tax - accepted most of the recommendations of a group of ministers from states on withdrawing exemptions with a view to rationalising the levy, officials said.   The panel headed by Union Finance Minister Nirmala Sitharaman and comprising representatives of all states and UTs, on the first day of the two-day meeting accepted the GoM\'s recommendation for reviewing the exemption from GST that packed and labelled food items currently get.
